Why request a finding?

A finding is an objective description of purely material facts. This allows a finding to serve as evidence in an insurance file or court proceedings. In addition, a finding can also lead to a faster solution in a mediation procedure.

Within Belgium, only a judicial officer can make a statement. The report of the finding is recorded in an official report or proces-verbaal. The judicial officer may also add photos, a screen shot or minutes of a meeting to the report.

 

What findings are there?

With a traditional finding, a judicial officer comes on site to draw up a proces-verbal of the finding. He will, for example, determine incorrectly executed construction works, storm damage, damage to rented buildings. He can also establish an inventory or estate description in the context of an inheritance. The result of an official competition must also be determined by a judicial officer. In case of a finding on the internet, a judicial officer does not need to visit the site, as what must be ascertained is available online. All you need to do is contact the judicial officer by email or telephone, after which he will get started.

 

What can be ascertained on the internet?

Now the internet plays such a big role in our daily lives, we see the number of findings on the internet increase rapidly. These findings are multifaceted. Everything you can think of we can ascertain.

For example, online you may be confronted with slander and defamation, unfair competition or plagiarism. You can have these infringements ascertained. In addition, you can also request a finding to prove that you show you General Terms and Conditions or the required legal notices clearly on your own website. You can also have it ascertained if your website has been hacked or build poorly.

 

How much does a finding on the internet cost?  

In Belgium it is required by law to register a finding (art. 8bis in the Code of Registration). This is done at the fixed rate of 50 EUR. In addition, the judicial officer must also be compensated for his work. This fee is not strictly determined by law and can therefore differ from one judicial officer to another.

Therefore, be sure to request a few quotes before choosing a judicial officer. Also inquire about the procedure of the judicial officer. Is he using special software to perform a finding on the internet? Such software saves him a lot of time and will ultimately result in a lower invoice.
