The stereotypical image of the judicial officer who inexorably collects debts is long gone. Judicial officers are primarily independent bridge-builders. They mediate so that all parties can come to a solution together. But how do our accredited mediators do that? They are happy to tell you!

What added value does the mediator training offer?

All judicial officers and employees of Modero are socially committed enthusiasts, but the training to become an accredited mediator makes a difference. Our accredited mediators have even more insights and specific knowledge. It is important to remember that they are not judges or arbitrators, but objective mediators.

For example, they are trained in nonviolent communication. This connecting conversation technique enables them to objectively find a solution that reconciles all parties involved. They also specialize in specific themes. Just think of a specialization in family affairs, civil affairs or commercial matters, and so on. Our accredited mediators listen, while ensuring a safe and calm environment. That way, those involved dare to share more. As a result, our mediators notice alarm signals more quickly and they can refer people with serious financial problems to aid agencies such as the Public Centre for Social Welfare (OCMW in Dutch, CPAS in French) or One.

Why is mediation so important?

The existing legal framework already offers many possibilities, but also regularly leads to expensive collection procedures that are disadvantageous for both the contractor (creditor) and the client (debtor). For example, there is no point in continuing to incur additional costs on top of the original invoice, when you know that the client cannot pay them and will eventually end up in a debt spiral. In this way we avoid not only that the contractor is left behind with the unpaid invoices, but also that the costs do not continue to pile up unnecessarily for the client.

That’s why mediation is so important. By means of open communication we can find a realistic payment solution in consultation with all parties involved. Thanks to mediation, we thus create more solutions in the amicable phase and collect with attention to the social context.

Who are Modero’s accredited mediators?

Mediation is essential for Modero. Modero does not mean ‘I mediate’ for nothing. The Modero Network now has eight accredited mediators. In Flanders you will be helped by Fanny Favyts or Jan De Meuter. Ronald Vanswijgenhoven and Cedric Dierends are at your service in Brussels. In Wallonia you can go to Roland Chartier, Maryline Langer, Séverine Koenig and Laurent Tonnus.

Rose Vandewall has already obtained the certificate of the postgraduate course in mediation. Once she has completed five years of professional experience, she is also eligible to be appointed as an accredited mediator.

François-Michel Huwart is currently following the course.
