What is a finding?

A finding gives you an objective description of observable facts. The report of this is recorded in an official report by a public official. This can serve as evidence in an insurance file or court proceedings. It can also lead to a faster resolution in a mediation procedure.

 

In which situation can I request a finding?

Private individuals, companies and governments can request a finding. You can request a finding about almost anything. Below we highlight the most common findings:

  1. incorrectly executed construction works;
  2. storm damage, fire damage or water damage;
  3. damage to vehicles, homes or your property through an accident or vandalism;
  4. an inventory or estate description (for example in the context of an inheritance);
  5. incorrect or defective delivery of a product, website or app;
  6. taking samples for water pollution, soil pollution or air pollution;
  7. hacking into your website or your social media accounts;
  8. slander and defamation via social media, mail, text message or e-mail;
  9. unfair competition or plagarism;
  10. disputes between employer and employee;
  11. unlawful claim to kilometer allowance or bicycle allowance;
  12. compliance with the competition rules of official competitions and Lotto draws;
  13. noise or odor nuisance;
  14. etc.
     
     

Where can I request a finding?

Within Belgium, only a judicial officer can draw up a finding. A judicial officer can make a tradition finding on the spot or do a finding on the internet.

 

What does a finding cost?

In Belgium it is required by law to register a finding (art. 8bis in the Code of Registration). This is done at the fixed rate of 50 EUR. In addition, the judicial officer must also be compensated for his working hours. Depending on the method and/or software used, working hours can quickly add up. Therefore, be sure to request a few quotes before choosing a bailiff.
