The judicial officer has access to various databases for the performance of his duties. He also has access to the database of the Vehicle Registration Service (hereinafter DIV). Following a change in law, this access has been expanded from today, 6 May 2021.

Until now, the judicial officer already had access to the DIV database. However, he could only consult this data in the context of a conservatory attachment and enforcement on motor vehicles and trailers.
Today, a new law will enter into force, fiving the judicial officer wider access. Judicial officers can now also consult the DIV for statement reports, solvency investigations and their general obligation to provide information.

This extension mainly enables the judicial officer to assess the solvency, or the actual financial strength, of the counterparty as accurately as possible. More specifically, the judicial officer will be able to better assess whether it makes sense to start the (judicial) execution of the claim.
In addition, the Eucaris Convention will also enter into force, which aims at the smooth prevention, detection and prosecution of violations of driving licenses, vehicle registration and other fraud and crime related to vehicles.
