Whistleblower Act: Report a breach

After the implementation of the EU directive of October 23, 2019, the Whistleblower Act was published in the Belgian Official Gazette on December 15, 2022. In accordance with the new law, Modero also provides access to a reporting channel for non-employees to make a report. This can be done by emailing to klokkenluider@modero.be, for both a written report and asking for a physical appointment or to request the notification manager's phone number for telephone contact.

With the Royal Decree of 22 January 2023, the government has designated the authorities that act as competent authorities for external reports of breaches under the whistleblowing regulations for the private sector.

These are the following authorities, each of which is responsible for their own domain:

  • the Federal Public Service for Economics, K.M.O., Middle Classes and Energy;
  • the Federal Public Service Finance;
  • the Federal Public Service for Health, Food Chain Safety and Environment;
  • the Federal Public Service for Mobility and Transport;
  • the Federal Public Service for Employment, Labour and Social Dialogue;
  • the Public Service Programming, Social Integration, Poverty Reduction, Social Economy and Urban Policy;
  • the Federal Agency for Nuclear Control;
  • the Federal Agency for Medicines and Health Products;
  • the Federal Agency for Food Chain Safety;
  • the Belgian Competition Authority;
  • the Data Protection Authority;
  • the Financial Services and Markets Authority;
  • the National Bank of Belgium;
  • the Supervisory Board of Auditors;
  • the authorities reported in article 85 of the Act of 18 September 2017 on preventing money laundering and terrorist financing and restricting the use of cash;
  • the National Committee for the Security of the Supply and Distribution of Drinking Water;
  • the Belgian Institute for Postal Services and Telecommunications;
  • the National Institute for Health and Invalidity Insurance;
  • the National Institute for Social Insurance for the Self-Employed;
  • the National Employment Service;
  • the National Social Security Office;
  • the Social Intelligence and Investigation Service;
  • the Autonomous Anti-Fraud Coordination Service (CAF);
  • Shipping Control.

Depending on the situation, support measures can also be provided to the reporters by the Federal Institute for the Protection and Promotion of Human Rights, such as:

  • Complete and independent information, final opinions that are easily accessible and free of charge, about the available procedures and remedies
  • Legal aid
  • Supportive measures, including technical, psychological, media-related and social support
  • Financial assistance
