Legal update: Div access extension for bailiffs
To perform his duties, the bailiff has access to various databases. He also has access to the database of the Vehicle Registration Service (hereinafter DIV). After a change in the law, this access has been expanded since today, May 6, 2021.
To date, the bailiff already had access to the DIV database. However, he was only able to access this information in the context of the custody and enforcement of motor vehicles and trailers.
Today, a new law comes into force, giving the bailiff wider access. Bailiffs can now also consult the DIV for findings, solvency investigations and their general duty to provide information.
This extension mainly enables the bailiff to assess the counterparty's solvency, or actual financial capacity, in the best possible way. More specifically, the bailiff will be able to better assess whether it is useful to start (judicial) enforcement of the claim.
In addition, the EUCARIS Convention is also coming into force, with which the legislator aims to quickly prevent, detect and prosecute offences concerning driving licenses, vehicle registration and other fraud and crime related to vehicles.
