Determination
A finding by a bailiff is the written description of a factual situation as he sees it, without adding interpretation or advice. The bailiff records this in an official document, a report of determination.
A report of assessment has authentic probative value. In exceptional cases, he may decide not to take the finding into account. If the bailiff strictly limits himself to factual observations without conclusions, there is usually no reason to ignore the document.
Determinations can be made, among other things, in the event of property damage, neighbor quarrels, construction disputes, digital communications (such as emails or messages) or contractual disputes. The price of a determination is freely agreed between the bailiff and the client, and depends mainly on the nature of the assignment and the time spent on it. Taxes are levied on this cost, namely €50.00 registration fee and 21% VAT.
